STATEMENT OF POLICY
Itawamba Community College ("ICC" or "the College") is committed to providing an environment free from sex-based discrimination, including sexual misconduct, in its programs and activities. The College's policy is to comply fully with the requirements of Title IX of the Education Amendments of 1972, the Violence Against Women Reauthorization Act (VAWA), the Jeanne Clery Act, as well as other applicable laws and regulations.
It is the policy of the College that no member of its community, including students, employees, contractors or visitors on its campuses/locations, shall engage in sexual harassment, sexual assault, dating or domestic violence, sexual exploitation or stalking toward any other member of the College community, or in connection with any College program or activity.
The College’s policy is to strongly encourage, and in some cases to require, reporting of sexual misconduct to the authorities listed herein, and to investigate reports of sexual misconduct promptly, fairly and thoroughly in order to ensure the safety of all members of the community. To that end, retaliation of any kind against any person who brings a complaint or participates in any capacity in proceedings under this policy will not be tolerated and will be independent grounds for disciplinary action.
Violence Against Women Reauthorization Act
The Violence Against Women Reauthorization Act of 2013 (VAWA) to the Jeanne Clery Act imposes obligations on colleges and universities under its Campus Sexual Violence Act (“SaVE Act”). Under the VAWA Reauthorization, colleges and universities are required to report domestic violence, dating violence and stalking in addition to the crime categories currently mandated by the Clery Act. Additionally, colleges and universities must adopt certain disciplinary procedures and prevention strategies.
Title IX
Title IX of the Education Amendment of 1972 and Section 504 of the Rehabilitation Act of 1973, as well as Itawamba Community College policy, prohibits institutional discrimination against students based on gender or disability. Students who have reason to believe that their rights under law or campus policy have been denied in such areas as admission, financial assistance, employment, residence hall assignment, disciplinary actions or other campus matters may seek to resolve in a prompt, fair and equitable manner.
